We don't know all the facts Rangi so we don't know how true either of your scenarios are.
But even if you are correct it's doubtful such actions are criminal. They could be but without knowing all the ins and outs one can not say.
The HSU certainly appears to have a strong case for civil action to recover monies from past management.
But IMO it will all be too difficult. Thomson will not stand for re-election and will vanish from the radar once he is no longer an MP.
