    I read your post Duped,
    and it is complicated for me to follow..

    but as it happens I have come across a fair bit of action re trusts and trustees cases in NZ..
    understandable after their GFC experiences and I read that they have one of the highest rate of trusts/population in the world.."The Nation Of Trusts"

    anyway amongst my reading is info like

    "1. There must be a separation of legal ownership (vested in the trustee)
    from equitable ownership (vested in the beneficiary)11 and
    2. There must be identifiable trust property."

    Perhaps 'legal ownership' should be separated
    in our/my laymans thinking from
    'equitable ownership'?

    That was a pretty informative, but complicated paper,imlo.
    and there are a number of NZ cases around the subject..
    but not exact replicars.Plenty happening though.

    Even the experts seem iffy...how can the general public hoped to understand what they invest in and how it should operate? Enter a government safety net...or K/NOT?
