I guess it depends how you calculate. McGovern allegedly stole 1/3 of the value of the company, by market capitalisation.
You'd have to imagine that nicking $26m (or $30m -- just because they got some of it back doesn't mean he didn't steal it) would be considered pretty serious. Though there's nothing in the various court documents about what exactly he's been charged with - perhaps they haven't charged him with anything yet.
