It's ALP ideology to let 3rd world criminal scum into the country and it's certainly against their ideology to deport such scum. Just look back at their policy when Rudd was elected. So while they make popular noises about being tough on illegal scum, it goes against their grain to do so.
Why did the current High Court come to a different decision than the HC did in 2004? The law hasn't changed, just one bench of judges is more left leaning and ideologically aligned with the ALP than the other
