Although I'm sure what's been demonstrated by AKP is indeed a working prototype of their invention, I agree that you can definitely get a patent without proving it works with a prototype.
The rules differ between jurisdictions, but the USPTO doesn't (generally) accept prototypes as a part of an application and won't necessarily require one.
They can ask for one though, and if you don't cough up, you've got no chance.
Any decent patent attorney would warn you to seriously consider whether you should bother trying to secure a patent without being able to prove the invention does as you claim.
1.91 Models or exhibits not generally admitted as part of application or patent.

(b) Notwithstanding the provisions of paragraph (a) of this section, a model, working model, or other physical exhibit may be required by the Office if deemed necessary for any purpose in examination of the application.
