So, I have not ever said this is some contrived long running scam or fraud. What I have said is there is little transparency and a severe lack of disclosure, and potentially a lot of misleading and deceptive behaviour.
Nor have I directly aimed criticism at any technical aspect of their "product" except to say their announcements around development have been repeated over the years.

What I think is this -
Anyone making money on AKP has already done so.
It's quite likely EM will produce a working MEMS audio chip - probably not AKPs though. (they have their own IP).

Until there is evidence of an event that contradicts my thinking, I will maintain it.
