Q. If BR's $12m is not fully used, and dare I say IF! things go very well at AN it may hardly be needed at all, does AVB still pay the full 2% NSR???

A. After re-reading the BR announcement it appears that this agreement is as binding for AVB, as it is for BR, therefore i believe the answer to your question is - No, AVB may not need to a) use the full $12m from BR, b) use any of the $12m from BR, and if the later is the case, then there will be no need to fork out any royalties.
