because the of the time it took, first challenging Jublia in the FDA’s “Orange Book’ and the publicity over that, the subsequent court/ legal process it gave a heads up to other drug companies to get their own ANDA(s) ready to submit.,without having to do any of the initial heavy lifting. So a couple of Pharma companies joined ACR the end , but by that tme ACR was already successful challenging the “OrangeBook”
