Facts are the ratios and not conditional anns came out AFTER the notice of meeting was received and before the vote so was considered extra infomation to be taken into account before voting and also enabled people to buy more shares before the vote knowing explicitly that the shares should be distributed within six months of listing BUT distribution was not conditional on listing. seems very clear to any fair and reasonable person.

checked a couple of those anns(lol. 13/1/11 ipo cancelled) but they dont say explicitly that distribution is conditional. just "should be distributed " or "to be distributed" within 6 months . It wasnt till korab did a strategic review and changed its mind about listing that it was pointed out that they had said unconditional and they then attempted to 'clarifiy' the ann from years ago to mean the exact opposite.
