Cougar chairman Malcolm McAully said yesterday the company had a "strong case" that the closure was unreasonable. He claimed the Department of Environment and Resource Management had acted unreliably on a falsely reported test result for benzene, and had applied incorrect water quality guidelines.

"Their actions cannot and still cannot be justified on the basis of these two minuscule levels," he said. "We believe it was politically motivated. We believe the people in positions of authority have succumbed to misinformation and pressures from local farmers and politicians. Cougar Energy has never contaminated."

In its statement of claim, the company says a "misleading and alarmist" media release on July 16 last year - which ordered the closure of the pilot project and warned residents not to drink bore water - was reckless as it did not reveal that the test results were 950 times lower than the national guidelines for groundwater.

Cougar's claim says that when the company asked why the release had been sent out, Mr Wall responded that the department "had to be seen to do something".
