It seems to me that to devise a scheme whereby someone sets out to create a false belief in others and in so doing to then financially benefit from that action is nothing more than an underhanded and deceptive practice.
If a car salesman misrepresents the condition of a car he is selling, that is against the law. Short selling is solely designed to misrepresent the true state of affairs in order create a benefit for the shorter, which can only occur by causing a detriment to the other party.
It is quite simply, stealing.
