In a commercial court each party can bring their case. A freezing of assets is the result of evidence given that they were gained from impropriety, or that there is a risk of them being disposed/transferred or hidden. The Court declined to extned the freeze, but that does not mean that there is no case against the fellow, most particulalry if the case consists of him distributing funds to other parties ie: it may have been provable that he does not have the assets
