An executed contract is not worth the paper its written on unless it stipulates a commitment by the buyer to a minimum order volume, and there are financial penalties on the customer for not placing orders. A "no risk" to the buyer contract is great when it comes to getting them to sign up, but if they are not obligated to actually ever buy anything, its worthless. And unfortunately, if two of their contracts have been proven to be "no commitment" there is a 99% chance that ALL their contracts are "no commitment". They probably should have spent some of that start up money on hiring an astute commercial manager - as a tech company that cant successfully transition to the commercial phase will dwindle and eventually die.
