    I think we need to understand that the lawsuit, amongst other things, is seeking injunctive relief for the decisions made by the BLM and USDFW and Dept of Interior, and to have these mining permissions made by them set aside.

    It doesn't matter that Ioneer is not in court.

    If the BLM and USDFW and Dept of Interior decisions are set aside, then effectively Ioneer does not have permission to develop the mine.

    Ioneer would then need to go back to re-submitting all development applications and go through the processes once more, and we are talking years of delay here, which is probably the entire tactic.

    The court now needs to decide whether it will hear the case.
    If it decides that there is no case, the environmentalists will submit the claim to a higher court.

    If the court decides to hear the case, and one of it's judgements is to then "set aside" the BLM and USDFW decisions that permit the development of the mine, then Ioneer will need to go back to the drawing board once again, and resubmit all applications.

    This is exactly what the environmentalists lawyers are pursuing.

    Ioneer does not have to be a party to the lawsuit, but will be crucially effected by it's outcome.
