My guess is that given approval is relatively close and Ergon still has not completed it's part as yet, I think Carbon Energy would like to be seen doing the right thing working in with the DERM, with Carbon Energy more thnan likely waiting for the final approval to increase to 5MW, yes they're allowed to do the 1MW and the wait in my opinion would be within reason but if push came to shove, then I feel they'd go ahead with 1MW as they are entitled to do under the current deal.
Meaning if DERM started to play hard ball wanting what looked like months and months more document submissions etc..etc...
Just an educated guess and reading between the lines I must say from when I had my conversation with Carbon Energy regarding them being okay to go ahead with 1MW.
