Your hypotheticals are not relevant 3gb. The judge would not ask what AGS would have done because that has nothing to do with the accusation of Q/H acting in a misleading and deceptive conduct.
If someone is charged with stealing your car, the judge would not ask you what you would have done with your car had it not been stolen.
