    Tormin is an existing mine, that does produce a product that is industrially required in the world.
    It goes without saying that mining is "a necessary evil".
    In all cases it is relevant and appropriate that the mining itself, rehabilitation and surrounding biodiversity is considered and managed in a responsible manner.

    The parameters and definitions of this however are often disputable and every party is trying to protect and promote their own interest or cause.

    However, making a commitment to meet conditions so as to get your section 94 notices lifted and then not doing them, is not being responsible.
    When one of those is specifically a court order to submit a motivation to the environment minister by a deadline, and you don't do it, then that is absolutely not managing the environmental commitments in a responsible manner.

    It is not about "stopping mining", it is simply about ensuring that things are done responsibly and in a way that leaves a mining zone with the possibility of good rehabilitation in future so that the full ecosystem can return, and also that the animals in the next zone mined will then have an area to move to whilst the new area is stripped back and prepared for mining of the resource.
    In many cases this would also need to take into consideration if any people would be returning to live in that zone later also.

    MSR/MRC had the opportunity to put the front foot forward and put e pro-active spin on it and then follow this up with a media run to show how they are "doing the right thing"...its called public relations. Instead they have gone and blown the opportunity in a very antagonistic and irresponsible manner with a display of complete disregard for the judicial process and environmental responsibility.
    This is 100% the responsibility of the in house legal counsel who did not manage the matter appropriately against the deadline.

    Someone said the other day that this will be a Pandora's box, and they are probably right in saying that.
    CER, and indeed DMR, are now in the advantageous position of being able to bring a contempt of court writ against MRC/MSR at any moment going forwards.
