The Fair Work Commission has found that Guzman Y Gomez (GYG) unfairly dismissed crew member Adrianna Permus, who worked at the Carousel, WA store from Feb 2023 to July 2024.
Ms Permus’s shifts were cut to zero after she raised a discrimination complaint about rostering.
Despite assurances she remained employed, she was not allocated any further work.
GYG offered no evidence to justify claims of poor performance or a breakdown in the working relationship.
Multiple co-workers described Ms Permus as hardworking, reliable, and trusted to train others.
The Commission ruled there was no valid reason for dismissal, and GYG’s handling of the matter was “harsh, unjust and unreasonable.”
Outcome:
Reinstatement was deemed inappropriate.
Compensation awarded: $10,252.35 (the maximum available under the Fair Work Act cap).
The decision highlights the importance of fair treatment of young and casual workers, and the risks for large employers who fail to follow due process.
