If isx had not been split, the ato could have ask to freeze JK’s isx shares which included ISXFEU anyway and it wouldn’t have mattered where isxfeu is incorporated.

If you got huge tax bill and money in bank, ato ask to freeze your bank balance and you can’t say it’s my overseas income from overseas business, ato looks at your asset not the source of asset to recoup the tax bill.
And if you want to transfer the money overseas saying it’s earned through overseas business, ato wants to prevent the transfer or wants to freeze the transferred amount if it’s already been transferred.
