    Dear 357,

Quoting from my posting to whatsnext on HC of 5 April:

    "Whatsnext,

The fact that there has been no announcement is positive for IPR as it means that the opposing positions are not that far away as to preclude talking until the last minute.

The fact that Juniper folded on the first day and paid up is also positive for IPR and will not tend to support the CLAN (Cisco-Lucent-Alcatel and Nortel Networks) position.

What's negative is that these four can band together and muster a lot of financial muscle to keep the case from early resolution.

But the thing that militates against that happening is the fact that Texas has a unique and quick method of dealing with such cases - which is why IPR filed the case under their jurisdiction.

So I expect an out of court settlement whereby IPR compromises on the amount that it could achieve if the case were heard but which gives an immediate return and serves to cement their IP position."

Further to my quote above and in reply to your posting on the half-assed "settlement", it all comes down to a matter of tactics.

If IPR had proceeded with this case against these four giants instead of the "divide and rule" tactic they might have faced a good outcome (in the hundreds of millions) which would have been appealed and payment delayed until 2008 when their patent (for this particular technology) expires anyway.

They apparently considered it better to split Nortel (possibly the heaviest user of the technology and reluctant to settle) off from the financial and legal support of the other three and pursue Nortel for the big bucks (which would include punitivce damages maybe) as well as simultaneously entrench their intellectual property rights and pursue other opportunitiues (via the new stream of cases) and receiving the revenue stream from the now acquiescent settlers.

Seems good to me and that's why I think that Graham's new options are exercisable @ 20 cents.

His strategy is certain to carry the share price a great deal above that.
