May I add a few potential porkies and ask anyone interested to verify?
- On exercising their right of PE in this JV, FAR is required to pay a $30m goodwill deposit confirming they are proceeding. If they are unable to perform, the $30m is lost. FAR have to date never offered this payment nor has it been requested.
- As an alternative (or secondary) claim in the arbitration filings, "damages" were requested by FAR. The ICC thus has the authority to make a financial award rather than a ruling to wind back the clock which may put the onus on FAR to prove and quantify their loss.
- Cath is openly stating she does not expect WPL to loose their 35% as a result of the arbitration and accordingly FID is not being impacted by the arbitration. I expect FAR will confirm this to anyone who asks.
