Trump never took the Subpoena to court, he claimed he returned all the documents when he hadn't. That is defying a Subpoena.
There is testimony and video of Trump's minions moving the documents, Trump even had some in his bedroom.

If Trump had of returned the documents when asked, he wouldn't be facing charges.
