Trump wouldn't be facing charges if he cooperated and returned the documents.
Trump, Biden, and Pence would have all been in the same boat if Trump decided to do what Biden and Pence did and cooperate, but that is just Trump being Trump, thinking he never has to take personal responsibility for any of his own actions.
