I agree with most of what you said...except the part of waiting it out behind NSW...
They are the FEDERAL Government and they KNOW there are existing laws allowing Asset to appeal to the Fed Court. They knew this would happen. They are no fools or are naïve enough to think they can wait it out. I think they will try and play it out through the courts and hopefully will be told to do their job by Justice Jackson. I really dont see any defence the FEDs (or NSW) have to keep going with this delay.
