"so why go through the façade of getting to the 14th Oct only to not submit any defence"

It's certainly a conflict of ideals. On one hand the lawyers would want the case to go on (to get paid) and to formulate the best possible defence for their client as a potential option (before they potentially concede), however, on the other hand I believe it is in the best interests of the Government to not file crucial documents pertaining to the process thus far and thus concede before the submission deadlines (unlikely to happen now).

If it were a private matter, their lawyers should have warned them about what is about to happen, and how any filings could potentially jeopardise a future case. Unfortunately for the Government, they move too slow to prevent this hazard, as we have witnessed.

I am excited to see the Government expose themselves with their filings, it's going to be great. This case might yield 2x wins:
    1) potentially exposing additional procedural unfairness and
    2) winning this case

Once this case is over, I'm sure there will be ample opportunities for shareholders to pepper the Government with freedom of information requests for all things PEP-11.
