because there is a misunderstanding of what discovery is.

people think advents lawyers get to range through govt files grabbing anything they want.

there is NO right of discovery in federal court and in particular judicial review.

you have to apply specifically to be provided with documents etc and have to have a pretty good reason for asking for them. It’s a very very narrow field of inquiry.

generally the evidence is limited to the formal statement of the decision maker of it’s reasons (in this case why it hasn’t made a decision) and the material that was before the decision maker at the time of the decision.

advent won’t be getting people diaries or all the imaginary things people they think they will.

hopefully they are just playing for time and dragging it out as long as they can. Perhaps as people have said until after an election.
