Not illegal, the prospectus disclaimer would have something about this in it, saying that the minimum subscription needs to be filled before the company can list, mean time those people that have put in for the IPO will just wait; further more your risk of buying an under-subscribed IPO that isn't underwritten is HUGE..
Get some underwriters already!!! -They'd be cheaper than issuing 1000 new prospectus'.
Also if FEX were to go bankrupt before listing those that bought into the FEX ipo and were never allotted shares will lose all their money without the chance to ever take it out.
