I assume that you are not familiar with litigation ?

If there is a cause of action it is usual to join all parties at the one time so that the evidence is heard at the one time and then liability is aportioned by the Court.

However if it transpires that it was not known of the cause of action at the time against a particular party , it is possible to commence new proceedings agaisnt the neew defendants

Not being in posession of all the pleadings we do not know what the real issue are about, I would not assume anything
