The conduct of the da over the term that the DOCA has been in place needs to be examined, in particular their decision to allow austroid to incur further debt, recommence mining and export concentrate (regardless of what price it was sold at) when the DOCA was not effective due to the firb condition precedent. The das conduct since the firb decision was made is also extremely questionable in regards to the extension and rebuffing other potential suitors when the DOCA should have been terminated immediately. The damages to shareholders would be for the market value of the exported concentrate, and any additional debt that austroid has accrued, etc. It the sort of scenario the no win no fee class action firms may take great interest in.
