Whilst I'm confident a higher SP will result from all of this, one thing that doesn't sit easy with me is the rationale that the Sedco claim had to be resolved before an asset sale.

From my experience, if an asset sale was to occur any liability or contingent liability would typically remain with the legal entity, that being NXS.

Therefore the outcome of this settlement would suggest a potential transaction for all of the equity of NXS is likely based on the condition of a transaction by early April. However what doesn't sit right is the fact that NXS have already announced that the only party interested in the whole company has walked away.

Does this mean there is another party waiting in the wings to pick up 100% of NXS? I certainly hope NXS are playing off the interested parties in "assets only" against the potential 100% interested party to ensure a "fairer market price" than what has already been offered.
