Sadly Duped I think you are right on all points! That is why I am so intent on documenting not only the failure of our responsible entity to deliver on what PIF investors were promised but also the failure of ASIC to regulate.
At the very least I would also expect that a smart lawyer would know the difference between a defauling lender and a defaulting borrower. That remains to be seen in the Forest Resort legal claim.
