On the other hand, Directors can be made personally liable in cases of fraud or insolvent trading. This one smells a lot like insolvent trading to me. Proving it is another matter.
Remember, the law is changed by actions that were deemed not actionable or had no standing or merit. And a lawyer willing to risk failure (not always easy to find)
