freeloading and class action

I don’t know where the misinformation comes from regarding who pays for group or class actions. What happens in the Federal Court is that a Statement of Claim is filed with a Schedule of the names of those persons whom the solicitors are acting for a number of reasons. Firstly, the courts recognize that solicitors should not be obliged to work for free for the benefit of persons who are freeloaders. Secondly, the Courts recognize that it can be very costly for non-paying participants to be kept informed either by letter or newspaper advertisement. Thirdly, the Courts recognize that class action lawyers should not be held accountable for not consulting on say a strategic decision with non-participating parties.

It is up to everyone to make up their own minds. However, it they fail to be a Participating Party and register, then they will get nothing. As poor a result as the GSL scenario !
