From my reading of Metcash's latest announcement and media reports, the ACCC has to lodge an application for an injunction to prevent Metcash acquiring Franklin's.
From media reports, Metcash feel that the judge wont grant a temporary injuction against them simply because the ACCC's case is so weak in terms of the appeal.
So if there is no successful injunction by Friday, then the ACCC's case has effectively collapse, regardless of any subsequent appeals by the ACCC.
