CXO awarded MPS status for this project. Difficult to see how FIRB would allow 100% ownership of Baldhill to a foreign company. The argument CHE is using is that their application was made before covid and FIRB rule changes.
No doubt the plaintiffs will be using the argument that FIRB didn't approve or deny the changes that led to the second DOCA in December 2020
