The Martu that put the ILUA together aren't the ones that want to pick it apart.
The Martu that put the ILUA together include some of the Martu that had the historic win against RWD in the NNTT (going by the board compositions and names in press releases).
Desert is now banging on about another historic win. No doubt exhibit A would be the rule book and how it was allegedly abused by the board and exhibit B would be the allegations of corruption and conflicts of interest.
Of course the overall game plan being Martu aren't in breach of contract because they never entered into a contract and everything is void. (Oh, and by the way RWD shareholders have no rights anyway).
Exhibit A has already been examined to varying degrees by the NNTT and ORIC and would be defended by certain Martu elders.
What they would like is a historic win that gets them out of a deal. A win would effectively be a win against a faction of the Martu that got them out of the deal in the first place AND then back in the deal on terms that this faction thought acceptable.
I hope that that any court would say that you lot are a bunch of idiots. What sort of precedent would this set for Australian NT and mining.
It wouldn't set a good one unless you happen to view the entire system with contempt.
There are a few reasons why they might want to unpick the deal, some may appear honourable such as "corruption", playing by the rulebook, the lake is sacred (songlines, cannibals etc) but we shouldn't discount the idea that, for some, RWD just isn't giving enough.
This idea is easy to sell to the people particularly as they haven't seen any money from the board.
However who has seen the money from this deal? Some of us might have a paper profit but apart from those that have traded a few, most of money is sitting in unexercised options or in fairly illiquid holdings. The main beneficiaries thus far have been the lawyers, and those Martu/Martu employees that have pocketed the RWD payments (lump sum and heritage). Even the brokers have taken options over cash.
Has anyone ever heard of such a debacle with any other ASX miner?
