After reading the 19-03-13 release again, I now notice BHP are only prepared to honor their "contractual commitment".
So not really misleading, and open to interpretation.

I can see how if the approval by the LGU needed BHP to agree on local expenditure demands not in the contract, then BHP can just say no, if they want a legitimate reason to walk away.
