I believe they mainly need it for legality. I don't mean to offend anybody by suggesting the union is diminished because of this main reason. Their rights are not seen as per a heterosexual union. I believe a heterosexual defactor holds more rights than two same sex people's rights.
If the marriage is outside of a 'holy' building and not 'witnessed' by God they are in the same situation as heterosexuals. The church doesn't consider a marriage 'real' unless it's witnessed by God with his blessing. I wish I had the link to the ignorant, arrogant article I read in The Western Australia by some punce pronouncing this. Totally set back the church decades, it's definitely an establishment that looks down on people.
