Are “Use Patents” relevant here?
For example, would a “Use Patent” (e.g. for MoA) give Race exclusivity to this “Use” and therefore little issue with competition for market share around this “Use” (despite potential complexities enforcing).
If so, would public HC discussions on new uses/discoveries impact the scope to file a “Use Patent”?
Given the new uses being discovered/theorised for Bisantrene, is it possible another organisation might identify a new use and apply for a "Use Patent" (irrespective of potential Race Patents on the new formulation), thus creating complexities around commercialisation.
