    You'll have to define 'scale' mate.

    IMO, 67t in 12 months isn't producing 'at scale' (I can't remember if this also includes the Stage 1 ~30t?)

    So, your option 2 would be most likely. However I do have to add that if indeed there's an offtake soon after expansion approval, I'm certain there would be conditions in there to protect AGY should they not be able to deliver. This is assuming the offtake is done before being able to actually produce at scale, or at a rate that the suitor is happy with anyway.

    IMO it would be a foolish gamble on both parties to sign anything definitive before being capable of producing the required quantity of product. I realise offtakes/financing are generally done well in advance of even construction stages, however we have the proof in front of us right now that they've reached a bottleneck which we don't know how long will take to resolve. So it will obviously depend on the conditions of the deal, I don't think JZ would be that incompetent to put the company at risk of legal action.
