I honestly can’t see the outcome of this court case playing a major role in the bigger picture either. NH3 is a nano-cap with limited legal resources, so it seems more likely they’d aim for a mutually beneficial outcome rather than a protracted battle. It does feel like NH3 may not have anticipated the McIntosh Graphite Project to become as lucrative as it’s shaping up to be and now view the $4 million GCM invested as undervaluing the opportunity. On the other hand, GCM has met all the requirements under the earn-in agreement, making it an uphill battle for NH3. As GCM’s resources and backers continue to grow, their legal abilities will naturally strengthen, which could make it less appealing for NH3 to drag this out. A settlement or resolution that works for both parties might ultimately be the most pragmatic outcome.
