first mover advantage isn't strictly true unless (at least referncing they had the pick of all ground) you can prove MEI had the opportunity to acquire or peg the tenure the vendor, which ended the VMM tenements into that co.

I assume they wouldn't have had the option to deal as any project generator would look to maximise leverage through striking a deal with a low MC co.

so the assumption is that MEI had the option to peg the tenure of VMM assuming it wasn't held by the OG vendor at the time.
