Brian may have wanted to acquire the Mercury Holdings in the past, but given he's already holding in excess of 20% the rate at which he can accumulate is somewhat throttled to 3% per 6 months under the ASX Exception Listing rule.
Unless there's an exception to the Exception rule it might also play a part as to why the on-market route has eventuated ?
