Guidance Note 14 specifies that it is the company that is responsible for flagging announcements as price sensitive. The ASX may disagree with the flag, or any other part of the announcement, and will then engage with the company to clarify or change the announcement or its characterisation.
"it's a free country and free speech forum to comment on whatever i want about the share" - with the provision that what you want to say must be true. It's in the HotCopper terms and conditions. If you just want spout whatever you want without regard to whether it's true, fair, helpful, ethical, polite or decent, do it on X.
