Amigos, the Mining Act in NSW is very clear about exploration licences, such as Trigg's at WCC. An Exploration Licence allows the company to explorer by minimal disturbance - allowable work includes soil surveys, rock surveys, geophysics, costeaning and drilling. Anything else, such as open pit digging, is not allowed. The licence requires the explorer and the landowner to negotiate an agreement in good faith and, if there is a problem, there is a process whereby the parties can ask the Mining department to appoint an arbitrator to adjudicate and make a final decision. The landowner is compensated for all exploration activities and any legal costs. And if, as a result of the exploration, a commercial resource is defined, then a new agreement for mining is needed with the Mining department and with the landowner.
