I don't want to tread on your private grief over the loss of those tenements, not the least of all because I'm a KOD investor, but has it not occurred to anyone that, perhaps the reason why BGS never heard anything from the Ministry about the ESIA, was because it may have been flawed if it was framed on the assumption that those tenements were in the bag for BGS? That seems entirely possible to me. And please, don't shoot the messenger!
