The data in most jurisdictions (apart from the US) does belong to the country. WDS paid for the data to be acquired and there must have been some 'understanding' with the MME and Namcor that WDS would be given access to the data for the purposes of evaluating the permit in order to decide whether to farm-in. It would be assumed that, until WDS has permission form Namcor (and MME) the raw and processed data and especially the interpretation of the data is 'confidential' and as such can not be released to any entity (including the ASX) by WDS as it does not belong to WDS and WDS are not a party to the Permit. Which I assume is why WDS have only made very vague references to PEL87 in the past.
PCL on the other hand have an obligation to keep the market informed of matters that may affect the valuation of the company, and this 'should' have nothing to do with WDS and I would seriously doubt that there are enough 'weasel' words in a lawyers dictionary to prevent the disclosure of information material to the valuation of PCL (ie an updated resource estimate for the plays) in the WDS contract with PCL. Could anyone correct me on this assumption?
There has been more than enough time for PCL to have got to this stage of the interpretation.
