    Just for a record that the public and perhaps in the future researchers can access I am putting another document on HotCopper.

    It seems the National Anti-Corruption Commission, (NACC), and its Commissioner, Brereton, will do what it can to avoid undertaking an assessment of my submission concerning NAIF and it Chief Legal Officer, Mr Chris Collins, and the SECRET $610 million concessional loan.

    Below is a copy of another email I sent to the Office of the Inspector of the NACC, yesterday. The email took up issues that have arisen from a recent High Court decision which will impact upon officers in senior management positions within organizations like NAIF and ASIC, (Mr Peter Witham).

    Officers, Collins and Witham, may have second thoughts about their actions in the future?

    Will Erin, on behalf of the Inspector of the NACC, Ms Gail Furness, respond to the 6 October email and make any reference to issues referred to the 8 October? The email is below:-

    Dear Erin


    I am bringing to your attention the attached article published by the ABC this morning.

    The article gives rise to concerns about the way in which NAIF's Chief Legal Officer, (Collins), and ASIC's, (Witham) have, (given the lack of evidence to the contrary), repeatedly refused to address matters concerning NAIF and its administration of the SECRET $610 million concessional loan and their respective dealings with the Solicitor-General and with one another. The wordsUNCONSCIONABLE CONDUCTseem particularly apt to the Skip Capital and Genex Power Ltd takeover bids/transactions? Both cases involved NAIF and ASIC allowing matters to proceed despite neither Collins or Witham being able to state that the corporations they represent, NAIF and ASIC, had legal advice that"although we weren't sure if the proposed transactions were legal, the advice we now have, (from the Solicitor-General and/or the AGS), has provided necessary legal clarification". The actual situation is that all parties to both transactions took the position:-“we don’t know if the transaction is legal but we will act as if it is”.

    The following seems particular apt with respect to Mr Collins and Mr Witham;-

    "This case is going to be noticed," adds Alexander Morris, partner at law firm King & Wood Mallesons (KWM).

    "Because really it says — if you're in senior management, where you have visibility over systems of conduct and patterns of behaviour — you in one sense, need to become the corporate conscience."

    In terms of ethical standards and the exercise of corporate conscience neither NAIF or ASIC were, in my view, well served by senior management. It has been as if the APS's code of conduct did not exist?

    Had appropriate ethical and corporate conscience standards been applied by NAIF management, particularly its Legal Counsel, (as far back as mid-2022), it is unlikely the NAIF Review Panel's attention would have been drawn to all the matters associated with the SECRET $610 million concessional loan and the Solicitor-General.

    I will be interested to read your response, (on behalf of Ms Furness), to my 6 October email.

    Given his deep interest and knowledge of the NACC; (since well before its inception), decisions of NACC Commissioner Brereton and the role of the Inspector of the NACC I have cc'd this email to Mr Shane Dowling, (The Kangaroo Court).

    Will be very revealing to see if Brereton and Furness work together to bury this matter.

    There are already many who are questioning the performance of the NACC - will this serve as confirmation that there are good reasons for the questioning?
