I suspect Australia is signalling that we expect to see evidence of fair play before the big stick comes out at our end. At our end there is a need to show we are prepared to listen to their argument to see if there is any legal sense to it.
I think if they hold this in camera and extend the hearing The Australian Government may step in with all the might that can be exerted.
The ramifications go well beyond FMS. Any deal with an overseas company could be terminated if this thing succeeds which means we could be robbed blind.
I don't think they will allow that. How it gets stopped is anyones guess.
Someone mentioned Viktoys 5% of FMG, yes, that actually is a conflict of interest and may well be part of what is happening. Bugger up has always been part of some peoples business plan.
