Hi thebarry, perhaps I can help clarify things according to my understanding.

You should note that there are 2 seperate legal proceedings occuring, one in the UK and the other in WA. It is my understanding that Rod via an ASX announcement on 21 July 2009 stated that GGG's interest in the JV is not in question. THIS RELATES TO THE UK PROCEEDINGS.

We were not informed about the WA proceedings until the announcement 31 August 2009. Ive only had a quick look and you may wish to check for yourself but I cant find any reference to Rod saying that GGG's interest isnt in doubt from that date forward. i.e. what GGG said about one proceeding doesnt necessarily apply to the other.
